Terms & Conditions
Enthral Services & Aviation Pvt Ltd, also referred to as “Enthral Aviation” in the following terms and conditions, is the facilitator of air charter services. The
term “Charterer” refers to the individual or entity booking and making payment for the flight request.
Quotation & Confirmation
The document provided is strictly a quotation/estimate. The availability of the aircraft is subject to confirmation, and the charter will only be
confirmed upon receipt of 100% of the payment in advance.
Additional Sectors
Any additional sectors required after the commencement of the flight itinerary will be at the sole discretion of Enthral Services & Aviation Pvt Ltd.
Additional costs incurred will be charged accordingly.
Minimum Booking Value
A minimum booking value equivalent to 2 hours of flying time, or as per the flight operator’s requirement, will be charged on a daily basis,
regardless of the actual flight time.
Flying Hours
The flying hours mentioned in the quotation are indicative only. Any deviations caused by weather conditions, air route unavailability due to Airport
Authority/Air Traffic Control decisions, or defense activity will be billed at actuals in the final invoice after the flight is conducted.
Parking & Repositioning
Parking at certain airports is subject to the availability of parking bays. In cases where parking space is unavailable, and the aircraft must be
repositioned or undertake a local flight to clear the bay, all costs associated with such repositioning will be billed at actuals in the final invoice.
Foreign Nationals
For flights involving foreign nationals traveling to a Defense Airfield, complete passport details, along with confirmed departure and arrival timings,
must be provided at least 10 working days prior to the flight. No changes will be accepted after submission to the Air/Naval Headquarters.
Contract of Carriage
While the invoice will be issued by Enthral Aviation, the contract of carriage and all associated liabilities are strictly between the Charter Operator
and the Customer. Enthral Aviation acts as a facilitator and bears no responsibility for the carriage contract.
Payment Terms
Upon confirmation of the charter, full payment must be remitted through the provided payment gateway or as specified in the Proforma Invoice.
Failure to remit payment on time will result in the automatic cancellation of the booking without further notice.
Request for Permissions
Requests for necessary permissions or approvals will only be applied for after full payment has been received. Enthral Services & Aviation Pvt Ltd
will not process any permission requests until the payment has been fully cleared.
Cancellation by Operator
In the interest of safety or due to technical reasons, the Operator reserves the right to cancel a charter without prior notice, even after receiving full
payment. Enthral Aviation will attempt to arrange a replacement aircraft through its network. If a replacement cannot be found, the Operator’s or
Enthral Aviation’s liability will be limited to a 100% refund of the payment made by the Customer. If the aircraft was repositioned and the
cancellation is due to bad weather, the ferry charges to return the aircraft to its base will be borne by the client.
Aircraft Technical Issues & Force Majeure
If the booked aircraft experiences technical issues or is affected by any force majeure condition after being positioned for passenger pickup, the
charterer will bear the cost of the positioning, including all legs flown. In the event that a replacement aircraft is arranged, the charterer will also
bear any additional costs associated with the replacement aircraft, including positioning fees and other applicable charges.
Illegal Activities
Enthral Aviation will not be held responsible for passengers carrying contraband items or engaging in illegal activities. Passengers involved in
such activities will be subject to legal action, and the charter will be immediately terminated without refund.
Changes in Product Offering
In the event of unforeseen circumstances, Enthral Aviation reserves the right to alter the product offering without prior notice. No claims or
compensation will be entertained.
Liability
Enthral Aviation shall not be liable for any financial damages or cancellations of flights due to technical issues, inclement weather, poor visibility,
lack of clearances, or any other factors beyond the company’s control. This offer is contingent upon the continuing availability of the aircraft at the
time of booking.
Acknowledgment
By accepting this Proforma Invoice, you acknowledge having read and accepted these terms and conditions, which constitute a legally binding
agreement between Enthral Aviation and you. The relevant Terms of Use apply to all Customers utilizing Enthral Aviation’s services.
Revisions to Charter Rates
Enthral Aviation reserves the right to revise charter rates without prior notice in response to increased operational costs, such as fuel prices,
landing, navigational/parking charges, government taxes, maintenance costs, etc. The maximum liability of the company shall be limited to the
amount paid by the client prior to the flight.
Advance Payment
A 100% advance payment is required at the time of booking as confirmation charges. Payment can be made via cheque/DD/wire transfer in the
name of ‘ENTHRAL SERVICES & AVIATION PRIVATE LIMITED.’ (Account details are provided in the Proforma Invoice/Estimate).

1.On non-flying days, if the aircraft is kept waiting by the client, 2 hours of flying time, or as per the flight operator’s requirement, will be charged as a
- ‘Non-Flying Day Charge.’
2.Any watch hour extensions levied by the airport will be billed separately after the flight.
3.Any additional charges imposed by the Airport Authority, Customs, or other regulatory authorities will be billed separately.
Crew detention charges will apply as per the day or night halt specified in the itinerary.
Role of Enthral Aviation as Facilitator
Facilitation of Services
Enthral Services & Aviation Pvt Ltd (“Enthral Aviation”) acts solely as a facilitator between the charterer and third-party flight operators or vendors.
Enthral Aviation will make arrangements and bookings for air charter services on behalf of the charterer based on the charterer’s requirements
and preferences.
Acceptance of Third-Party Terms
By engaging the services of Enthral Aviation, the charterer expressly agrees to accept and be bound by all terms and conditions set forth by the
respective flight operators or vendors, either directly or indirectly. It is the charterer’s responsibility to review and understand these terms and
conditions prior to confirmation of the booking.
Availability and Booking Confirmation
All bookings made through Enthral Aviation are subject to the availability of the aircraft and necessary approvals from relevant authorities at the
time of confirmation. Enthral Aviation does not guarantee availability until the booking has been fully confirmed and all requisite permissions have
been obtained.
Changes, Cancellations, and Price Variations
Enthral Aviation shall not be held liable for any changes, cancellations, or unavailability arising during the booking process due to factors
including, but not limited to:
Non-Availability of Aircraft: Situations where the selected aircraft becomes unavailable before or after booking confirmation.
Denial of Permissions: Failure to obtain necessary permits, licenses, or approvals from aviation authorities or other regulatory bodies
required for the operation of the flight.
Price Increases: Any increase in charter costs imposed by the flight operator or vendor prior to the confirmation of the booking.
Operational Constraints: Any other operational reasons beyond the control of Enthral Aviation that affect the execution of the flight
services.
Liability Limitation
In the events described above, Enthral Aviation’s liability is strictly limited to:
Efforts to Resolve: Making reasonable efforts to find alternative arrangements suitable to the charterer’s requirements, subject to
availability and additional costs which shall be borne by the charterer.
Refunds: Refunding any payments received from the charterer for services not rendered, excluding any non-refundable deposits or fees
as specified by the flight operator or vendor.
No Further Claims: The charterer agrees that no further claims, compensations, or damages shall be sought from Enthral Aviation for
losses or inconveniences arising from such changes, cancellations, or price variations.
Charterer’s Responsibility
The charterer acknowledges and accepts that all risks associated with changes in availability, permissions, and pricing are inherent in the nature
of air charter services and agrees to indemnify and hold Enthral Aviation harmless from any losses, damages, or additional costs incurred as a
result of such events.
Operator’s Liability
The aircraft operator is solely responsible for the operation and maintenance of the aircraft, and any claims or disputes arising from the charter
service will be directed to the operator. Enthral Services & Aviation Pvt Ltd acts solely as a broker and is not liable for any operational issues,
including but not limited to delays, technical failures, or other disruptions. The broker shall be indemnified against all claims, losses, or damages
arising from the charter service.
Indemnity Clause
The charterer agrees to indemnify and hold harmless Enthral Services & Aviation Pvt Ltd, its directors, officers, employees, and agents from any
and all claims, demands, damages, liabilities, losses, and expenses (including legal fees) arising from or related to the charter service, including
any third-party claims. This indemnity applies irrespective of the cause, including negligence, breach of contract, or any other legal theory.
Cancellation Policy
Cancellations made by the charterer will incur the following charges:
100% of the charter cost for no-shows or cancellations within 3 days of the scheduled departure.
75% of the charter cost for cancellations within 7 days of the scheduled departure.
55% of the charter cost for cancellations within 15 days of the scheduled departure.
25% of the charter cost for cancellations made more than 15 days but within 24 days of the scheduled departure.
All bookings, whether made through email, phone, or in-person, are legally binding and subject to these cancellation terms.
