Terms & Conditions

Enthral Services & Aviation Pvt. Ltd. ("Enthral Aviation") acts as a facilitator of air charter services. "Charterer" refers to the individual or entity booking and paying for a flight request. These terms govern every charter arranged through Enthral Aviation.

1. Quotation & Confirmation

Any document provided is strictly a quotation/estimate. Aircraft availability is subject to confirmation. The charter is confirmed only upon receipt of 100% advance payment.

2. Additional Sectors

Any additional sectors required after the flight itinerary has commenced are at the sole discretion of Enthral Aviation, and additional costs incurred will be charged accordingly.

3. Minimum Booking Value

A minimum booking value equivalent to 2 hours of flying time, or as per the flight operator's requirement, is charged daily, regardless of actual flight time.

4. Flying Hours

Flying hours in the quotation are indicative only. Deviations due to weather, air route unavailability, or defense activity are billed at actuals in the final invoice.

5. Parking & Repositioning

Parking at certain airports is subject to availability. If parking is unavailable and the aircraft must reposition, costs are billed at actuals.

6. Foreign Nationals

For flights involving foreign nationals traveling to a Defense Airfield, complete passport details and confirmed timings must be provided at least 10 working days prior to the flight. No changes are accepted once submitted to the Air/Naval Headquarters.

7. Contract of Carriage

While the invoice is issued by Enthral Aviation, the contract of carriage is strictly between the Charter Operator and the Customer. Enthral Aviation acts only as a facilitator and bears no responsibility for the carriage contract.

8. Payment Terms

Upon confirmation, full payment must be remitted through the provided payment gateway or as specified in the Proforma Invoice. Failure to remit payment on time results in automatic cancellation without notice.

9. Request for Permissions

Permission requests are only applied for after full payment is received. Enthral Aviation will not process any permissions until payment has cleared.

10. Cancellation by Operator

The Operator reserves the right to cancel a charter for safety or technical reasons. Enthral Aviation will attempt to arrange a replacement aircraft. If no replacement is available, liability is limited to a 100% refund of the payment made. If an aircraft was repositioned and cancellation is due to bad weather, ferry charges to return the aircraft are borne by the client.

11. Aircraft Technical Issues & Force Majeure

If the booked aircraft experiences technical issues or force majeure, the charterer bears the cost of positioning and flown legs. Additional costs for a replacement aircraft, if arranged, are borne by the charterer.

12. Illegal Activities

Enthral Aviation is not responsible for passengers carrying contraband or engaging in illegal activities. Such incidents result in immediate termination of the charter without refund.

13. Changes in Product Offering

Enthral Aviation reserves the right to alter the product offering due to unforeseen circumstances, with no claims or compensation entertained.

14. Liability Disclaimer

Enthral Aviation is not liable for financial damages or cancellations due to technical issues, inclement weather, poor visibility, lack of clearances, or other factors beyond the company's control. Enthral Aviation bears no liability for any direct, indirect, consequential, or incidental damages arising from charter cancellations or delays.

15. Revisions to Charter Rates

Enthral Aviation reserves the right to revise charter rates due to fuel price hikes, landing/parking/government tax increases, or other operational cost fluctuations. The company's maximum liability is limited to the amount paid before the flight.

16. Advance Payment

A 100% advance payment is required for confirmation, payable by cheque, DD, or wire transfer to Enthral Services & Aviation Private Limited (bank details provided in the Proforma Invoice).

17. Other Charges

On non-flying days, a minimum of 2 hours of flying time is charged. Any watch hour extensions or additional charges by Airport Authorities are billed separately. Crew detention charges apply as per the itinerary.

18. Role of Enthral Aviation as a Facilitator

Enthral Aviation acts solely as a facilitator between the charterer and third-party flight operators. The charterer agrees to be bound by the terms and conditions of the flight operator.

19. Changes, Cancellations & Price Variations

Enthral Aviation is not liable for cancellations due to non-availability of aircraft, denial of necessary permissions, price increases before confirmation, or other operational constraints. Refunds are processed for services not rendered, minus non-refundable deposits.

20. Operator's Liability

The aircraft operator is responsible for all operational aspects, including delays, technical failures, or disruptions. Enthral Aviation is not liable for these issues.

21. Indemnity Clause

The charterer agrees to indemnify and hold harmless Enthral Aviation from any third-party claims, legal liabilities, or other associated losses, damages, costs, or legal expenses arising from disputes related to the charter service.

All bookings, whether made through email, phone, or in person, are legally binding. This schedule works alongside related clauses on this page — Minimum Booking Value (§3), Cancellation by Operator (§10), and Aircraft Technical Issues & Force Majeure (§11).

23. Insurance Clause

All charter flights are insured by the respective charter operator. Insurance coverage and policy terms are governed by the operator's insurance provider. Enthral Aviation is not liable for any claims related to aircraft insurance coverage.

24. Legal Compliance

This agreement is governed by and construed in accordance with the laws of India. Any disputes arising out of or related to this agreement are subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

25. Binding Agreement

By making payment and proceeding with the booking, the charterer acknowledges and agrees to be bound by these terms and conditions. No separate signature is required — the terms are automatically enforceable upon booking confirmation.
